遗嘱信托法律问题分析

随着经济的发展,个人所有的财产将会越来越多,但是人的生命是有限的,不可避免的面临继承问题。继承的最大目的就是让子孙后代生活有保障,有些情况下继承人没有能力或者能力不足管理巨额、专业的资产。从而不仅不能保障子孙的生活,还可能面临财产灭失的风险。我国在《信托法》中确认了遗嘱信托制度,这是对我国面临的现状提供了一个很好的解决方法,但有关遗嘱信托制度的规范体系现在还没有建立起来,现实需求与制度落后的矛盾日益增加。与此相比较,英美等信托较发达的国家,遗嘱信托业务已经开展,并取得一定的经验,各方面的制度都已经建立。本文将分为四个部分,第一部分将在案例中寻找到学理观点,分析其法学上的问题。第二部分是对遗嘱信托基本问题的阐述,这是我们接下来将要讨论的理论基础,只有在了解理论根源的基础上,才可以得出符合事物本质的结论。第三部分是我们遗嘱信托的现状,这里与之对比的是英美国家,我国现在的遗嘱信托处于刚刚发展的阶段,有大量的问题涌现,这是我们首先要注意到的。第四部分是针对我国现有的情况对我国的遗嘱信托制度进行构建与完善,吸取先进经验的基础上,还要结合我国自身的情况,找到适合我国自身遗嘱信托产业发展的道路。
