面对公益损害如何寻求司法救济,这是我国法律实践中面临的一个新课题。在我国,相关的公益诉讼制度尚未建立,但在社会实践中已出现了大量的公益诉讼案例,并对我国公益诉讼制度的构建提出了客观要求。文章从“公益诉讼”在我国的发展现状及构建我国公益诉讼制度的必要性、可行性等方面进行了阐述,并提出了解决的对策。
In the face of public welfare damage how to seek judicial relief, this is a new topic that our country faces in law practice. In our country, the relevant public interest litigation system has not been established yet, but a large number of public interest litigation cases have appeared in the social practice, and the objective requirements have been put forward for the construction of the public interest litigation system in our country.
