2011年2月14日《人民法院报》头版头条刊登了消息“陕西省委省政府为西安中院记集体一等功”。阅读该文后窃以为该做法起码有四大不妥之处,不应宣扬和提倡:一、违反了行政管理制度。为所属单位表彰或记功的行为是系统内部的行政管理行为。上级管理机关对体制外的单位进行奖惩系越权无效行为。
February 14, 2011 “People’s Court Newspaper” front page published the news “Shaanxi provincial government for the Xi’an Intermediate People’s Court record first class work.” After reading this article, we think there are at least four major pitfalls in the practice and should not be advertised or promoted: First, it violates the administrative system.
