改革开放以来,我国职业许可的法治化经历了建立、发展与不断完善的过程。我国职业许可法治化存在的主要问题包括:权利保障理念缺失,立法层次总体较低,考试太乱、证书太滥等。推进我国职业许可法治化进程,需树立职业许可的谦抑理念,重视职业认证的替代作用,提升职业许可的立法层次等。
Since the reform and opening up, the legalization of our vocational license has undergone a process of establishment, development and continuous improvement. The main problems existing in the legalization of occupational license in our country include: the lack of the concept of rights protection, the low level of legislation overall, too messy exams, too many certificates and so on. To promote the process of legalization of occupational license in our country, it is necessary to establish the modest concept of occupational license, emphasize the substitution effect of vocational certification, and enhance the legislative level of occupational licensing.
