校企合作法律保障机制的构建既是推进职业教育校企合作发展的政策导向,也是深化校企合作的现实需求。但是在当前的职业教育体制条件下,并没有一个通用性的法律保障机制甚至没有一部地方性法规可供采用。政府对校企合作在政策、法律、制度的约束和支持力度不够,很多只是框架上的约束,因而制约了职业院校校企合作的进一步发展。本文对国家高等职业教育发展规划等政策及我国职业教育校企合作保障机制的缺失加以分析,建议出台《黑龙江省职业教育校企合作促进条例》,建立我省职业教育校企合作法律保障体系。
The construction of legal guarantee mechanism for school-enterprise cooperation is not only the policy direction to promote the cooperation and development of school-enterprise in vocational education, but also the realistic demand to deepen the cooperation between school and enterprise. However, under the current system of vocational education, there is no universal legal guarantee mechanism or even no local laws and regulations to be adopted. The government has not enough restraint and support for policies, laws and institutions on the cooperation between schools and enterprises. Many of them are just constraints on the framework, which limits the further development of school-enterprise cooperation in vocational schools. This paper analyzes the policy of national higher vocational education development planning and the lack of cooperation guarantee mechanism of vocational education in our country. It is proposed to promulgate the Regulations on Promoting the Cooperation of School-enterprise in Vocational Education in Heilongjiang Province and to set up the law guarantee system of cooperation between schools and enterprises in vocational education in our province.
