我国的民事审前准备程序存在着诸多问题,改革完善势在必行。中法两国民事审前准备程序在法律框架、实践层面上有同亦有异。改革和完善我国目前的审前准备程序不能冒进,应在现有法律制度的基础上,借鉴与我国法律文化相似国家的经验,根据我国的国情进行。
There are many problems in the civil pretrial procedure in our country. It is imperative to reform and perfect it. The procedure of civil pre-trial preparation between China and France is similar in both legal framework and practice. Reform and Perfection Our country’s current pretrial preparation procedure can not be aggressive. On the basis of the existing legal system, we should learn from the experience of countries with similar legal cultures in our country and conduct our own trial according to our national conditions.
