【裁判要旨】优先租赁权是由当事人约定产生的同等条件下的优先缔约请求权,既不具备对抗第三人和物权的效力,也不具备单方形成新合同关系的效力,对该请求权不宜通过强制履行的方式进行保护。原合同到期终止后,承租人依据优先租赁权抗辩出租人提出的返回租赁物请求及要求判令出租人与其签订新租赁合同的诉请,均不应支持。
