本文着重阐述了《纽约公约》中的“更优权利条款”在当今国际商事仲裁中的基石作用 ,以及在具体适用“更优权利条款”过程中应关注的一些法律问题。本文提示人们注意研究“更优权利条款”与国内法 ,以及其他国际条约的一些法律关系问题。
This article focuses on the cornerstone role of the “Better Clauses of Rights” in New York Convention in today’s international commercial arbitration and some of the legal issues that should be of particular concern in the application of the “Better Clauses.” This article prompts people to pay attention to study some of the legal relations between “better rights clause” and domestic law, as well as other international treaties.
