一、缘起西溪正庐小区位于杭州市西湖区五常港路与紫霞街交叉口西北,为新建小区,共20幢楼房;2015年8月份,该小区完成竣工验收。竣工验收后,该小区的建设单位利用竣工验收和房屋交付的监管空档期间,未经规划等行政部门审批,擅自占用小区配套绿地400余平方米,对其中的14幢楼的一楼搭建砖混结构的围墙,形成了对应一楼住户专有院落。2015年12月,随着部分住户的陆续入住,有关居民发现了其中
