我国实行的是区别于土地私有制的一种具有中国特色的土地制度,我国城镇土地依法属于国家所有,可以自由流转、开发利用的是建设用地使用权,且该建设用地使用权存在期限限制。那么,势必会产生建设用地使用权到期后其上的房屋等建筑物的所有权归属问题。从分析现行法对上述问题规定的本身出发,梳理现行法存在的不足和问题,进而提出了为解决这一问题的若干理性思考,如明确建设用地使用权续约主体、续约的程序和条件、法定续约权的确立和保障等等,以期对解决这一冲突有所裨益。
Our country implements a kind of land system with Chinese characteristics which is different from the private ownership of land. Our country’s urban land belongs to the state according to law and can be freely circulated. The development and utilization of the land is the right to use the construction land, and the term of use of the construction land is limited. Then, it is bound to produce ownership of the building after the expiration of the right to use construction land ownership issues. Based on the analysis of the existing provisions of the existing law on the above issues, this article combs the existing problems and problems, and then puts forward some rational considerations to solve this problem. For instance, it clarifies the procedures and conditions for renewing the main body of construction land use rights, The establishment and guarantee of the right of renewal and so on, with a view to the solution of this conflict is helpful.
