近年来,在铁路检察机关立案查处的渎职侵权案件中,警贼勾结案件占有相当大的比例。对于铁路警察尤其是列车乘警的主体身份认定,司法实践中存在着较大的分歧。如何理解铁路乘警的身份及其职责,并准确认定此类人员违法犯罪的性质确实是一个值得探讨的问题。为此,人民检察杂志社与辽宁省大连市铁路运输检察院联合邀请专家结合具体案件就这方面的问题进行了深入、细致的研讨,以期对类似案件的准确定性有一定的参考作用。
In recent years, police prosecutors investigated and dealt with cases of dereliction of duty infringement, police thieves collusion accounted for a large proportion of cases. For railway police officers, especially the identity of the main police officers and soldiers, judicial practice, there is a big difference. How to understand the identity and responsibilities of railway police officers and accurately identify the nature of such crimes is indeed a question worth exploring. To this end, the People’s Procuratorial Press and Dalian City, Liaoning Province Railway Transport Procuratorate jointly invited experts to combine specific cases on this issue in-depth and meticulous discussions in order to accurately determine the similar cases have a certain reference.
