建立在交往理性基础之上的法律体系与公共领域交往产生的普遍主义道德具有同源性,即都产生于交往实践这一过程。同时法律体系的合法性核心依旧来自交往理性中的道德维度,其余维度在事实经验中都要经受道德维度的检验。如果说普遍主义的道德世界涵盖了所有自然人而超越时空,具有永恒性特征的话,法律体系则是具有独立性的权利主体为实现实践自决、自我组织而创建的行动规范。
The legal system established on the basis of communicative rationality has the same origin with the universalism ethics generated by the public domain interaction, that is, it all arises from the process of communicative practice. At the same time, the legitimacy of the legal system still comes from the moral dimension of communicative rationality. The remaining dimensions are subject to the test of moral dimension in factual experience. If the universal moral world covers all natural persons and transcends time and space and has the characteristics of eternity, the legal system is the code of conduct for the independent rights body to realize self-determination and self-organization.
