文章试图系统地追思刑事法学之核心命题,即“犯罪本体论”之问题。首先,评判了“形式主义”的犯罪概念之优劣;其次,审视“实质主义”的犯罪定义之长短,从而指出犯罪范畴之建构的双重难题;最后,深入研究分析犯罪范畴之建构,既要整合“形式和实质”的思维路径,又要跨越法教义学和社科法学的思维进路,从整体和系统之思维视角来构建科学的犯罪定义,即犯罪本体论。故此,文章认为,犯罪之定义,乃是指具有构成要件该当性、违法性、罪责性等三个要素的刑事不法,经由刑事立法赋予刑罚之行为。
The article attempts to systematically trace the core proposition of criminal law, namely “the crime of ontology” issue. First of all, it judges the pros and cons of the concept of crime of “formalism”; secondly, examines the definition of crime of “essentialism” and points out the double problems of the construction of the category of crime; finally, It is necessary not only to integrate the thinking path of “form and substance”, but also to go beyond the thinking path of legal and social science jurisprudence to construct a scientific definition of crime, that is, ontology of crime from the perspective of holistic and systematic thinking. Therefore, the article argues that the definition of crime refers to criminal behavior that has the criminal sanction of the three elements of the due elements, illegality and culpability of the constituent elements, and gives penalties through criminal legislation.
