2008年的春节联欢晚会(以下简称“春晚”)无疑是成功的,但是在其刚播出后不几天,就遭遇了重庆摄影爱好者李林的知识产权侵权指控,与此同时,春晚的作品也在遭受着他人的肆意侵权。笔者试图拨开迷雾,在本文中分析了春晚作品的知识产权权利归属问题,并分析了主动侵权与被动侵权的原因,并尝试对综合治理该问题提出了一些新观点。
The 2008 Spring Festival Gala was undoubtedly a success, but just a few days after its broadcast, Li Lin, an intellectual photographer in Chongqing, was accused of infringement of intellectual property rights. At the same time, Spring Festival Evening’s work is also subjected to arbitrary wanton infringement by others. The author attempts to get rid of the fog. In this paper, the author analyzes the ownership of IPRs in the Spring Festival Gala and analyzes the reasons for the active infringement and passive infringement. At the same time, I try to put forward some new ideas on the IPR.
