中共十八大以来,我国立法工作取得了举世瞩目的显著成绩。但在新形势下,全面深化改革对立法提出了一系列新要求,迫切需要加强立法主体的立法能力建设,不断提高立法效率和立法质量,为国家治理现代化提供更多的“良法”产品。立法能力是国家治理能力现代化的重要组成部分,是立法主体按照立法程序行使立法权力,通过立、改、废、释等方式提供立法产品,及时满足经济社会文化发展对立法需要的一种能力。提高立法能力,一是应当暂停人大常委会目前实行的会期制,改为实行全年会期制,每天八小时坐班制;二是加快推进人大常委的专职化、专业化、年轻化;三是推行立法助理制度,给人大常委全面配备立法助理;四是进一步加强立法专业智库建设。
Since the 18th CPC National Congress, our country’s legislative work has made remarkable achievements that have attracted worldwide attention. However, under the new situation, the comprehensively deepening reform has put forward a series of new requirements on the legislation. There is an urgent need to strengthen the legislative capacity-building of the legislative body and continuously improve the efficiency of legislation and the quality of legislation so as to provide more “good law” products for the modernization of state governance . Legislative ability is an important part of the modernization of the government’s ability to govern. It is an ability of legislative bodies to exercise legislative power in accordance with legislative procedures and provide legislative products through legislation, reform, abolition, release and so on, so as to timely meet the needs of economic, social and cultural development for legislation. First, it should suspend the current system of the Standing Committee of the People’s Congress, to implement the full-year system, eight hours a day shift system; second is to accelerate the NPC Standing Committee full-time, professional, young; third is the implementation of Legislative assistant system, to the NPC Standing Committee fully equipped with legislative assistant; Fourth, to further strengthen the legislative professional think tank building.
