随着金融产品的发展,在金融监管的空隙和疏漏处侵害金融消费者权益的问题就随之凸显出来。由于金融消费者的权利有其不同于传统消费者的特殊性,金融消费者处于信息不对称的弱势一方,然而,传统的消费者保护机制令消费者承担的举证义务太重,这使得现有的权利救济体系不能满足金融消费者的维权需要。本文针对我国信息披露制度、适当投资者制度尚处于起步阶段而传统民事救济体系又无法适应金融消费的新发展的现状,有针对性地提出了建立佣金披露制度,冷静期制度以及设立金融审判庭等多重保护途径,试图探索保护金融消费者特殊权利的新道路。

In view of the information disclosure system in our country, the proper investor system is still in its infancy and the traditional civil remedy system can not adapt to the new development of financial consumption. We put forward the proposal of setting up a commission disclosure system, a cooling-off period and setting up a financial tribunal And other multiple protection ways, trying to explore new ways to protect the special rights of financial consumers.
