2008年7月21日通过的宪法性法律标志着一次法国宪法改革的实现。这次改革在没有改变制度本质的情况下,大规模地修订了宪法的众多条款:考虑到总统在制度中优先地位的同时限定了他的权力;重新平衡了各机构间的关系从而使之有利于议会;考量了司法机构今后所具有的地位。这次改革带来的一系列改变将影响司法实践以及法律规范的起草。而且,无论是在基本权利的内容还是在民主的运行方面,这次改革也谨慎地为宪法加入了新的关注点。
The constitutional law passed on July 21, 2008 marks the completion of a French constitutional reform. The reform amends many articles of the Constitution on a large scale without changing the nature of the system: by taking into account the president’s prioritization in the system, while at the same time defining his power; rebalancing the relations between the agencies so that Conducive to parliament; consider the future status of the judiciary. A series of changes brought about by this reform will affect the judicial practice as well as the drafting of legal norms. Moreover, this reform has carefully added new concerns to the Constitution, both in the content of its basic rights and in the operation of democracy.
