限制、减少乃至废止死刑已成为国际社会的潮流与趋势,我国的死刑改革也正在紧锣密鼓地进行。现阶段我国死刑制度的改革应坚持立法改革与司法改革齐并进的思路,立法上进一步削减死刑,司法上严格控制死刑的适用。在当前我国死刑限制适用领域,应特别值得关注和研究一些重大现实问题。死刑民意问题、死刑观念问题、死刑政策问题、死刑适用标准问题、死刑案件量刑情节问题、死缓制度等问题,对死刑司法控制具有关键和核心作用并制约着死刑制度改革的进展。对这些问题的研究和解决往往是深入推进死刑限制适用乃至死刑制度改革的重要契机。 Limiting, reducing or even abolishing the death penalty has become the trend and trend of the international community.
