本文研究对象是作为交易组织和规制制度的家庭。家庭、企业及市场都是代表性的交易组织形式和规制制度,本文首先对不同的交易组织的契约性质进行总结和界区,然后从交易成本(包括交易联结成本)、风险分担的角度说明交易方式确定的影响因素。并且在理解正规制度和非正规制度对交易规制的一般性特点基础上,认识家庭、企业和市场作为组织制度在规制其内部交易方面的具体特征,从而阐述违约风险与规制方式的关系。最后,本文基于交易方式的特征对交易组织的选择进行了模型分析和阐述。
The object of this paper is the family as a trading organization and regulatory system. The family, the enterprise and the market all represent the form of the trading organization and the regulation system. This article first summarizes the contractual nature of the different trading organizations and the precincts, and then states the transaction from the perspectives of transaction costs (including the transaction cost) and risk sharing The way to determine the impact of factors. On the basis of understanding the general characteristics of formal regulation and non-formal regulation of transaction, we recognize that family, enterprise and market are the specific features of the organizational system in regulating their internal transactions, so as to explain the relationship between default risk and regulation. Finally, based on the characteristics of the transaction mode, the paper analyzes and expounds the choice of the transaction organization.
