针对计算机程序的软件版权保护与专利保护相关内容进行研究,提出计算机软件版权保护的优缺点,优点主要有具备相应的自动保护原则等,缺点有没涉及到软件构想等。结合这些问题,对计算机软件专利保护进行探讨,其中包括计算机软件专利申请阶段注意事项,计算机软件专利审查阶段应对策略,计算机软件专利维权焦点等,对这些内容进行分析,以期为计算机程序的软件版权保护与专利保护工作提供一定帮助。
Research on software copyright protection and patent protection related to computer programs is carried out. The advantages and disadvantages of computer software copyright protection are proposed. The advantages are mainly related to the principle of automatic protection. The disadvantages are not related to the software concept. Combining these issues, this paper discusses the patent protection of computer software, including the matters needing attention during the patent application phase of computer software, the coping strategies of patent examination of computer software and the focus of patent protection of computer software, and so on. Protection and patent protection to provide some help.
