反腐倡廉建设是党的十七大报告中提出的一个新的概念,要把反腐倡廉建设放在党各项任务中的突出位置,将预防和打击腐败进行到底,这关系到党和国家的生死存亡。但是,随着我国经济的高速发展,利益的巨大驱使和诱惑,使党的内部贪污腐败现象仍然存在。其中多以共同犯罪的形式出现,这种共同贪污犯罪的行为对党的内部廉洁性和社会公共财产产生了极大的危害。本文拟从定义、主观方面、客观方面、共同贪污犯罪行为的数额问题来正确认定公职人员的共同贪污犯罪,以此来更好地帮助党内查处违法违纪行为,纯洁党内队伍。
Combating Corruption and Advocating Honest Propriety Is a New Concept Proposed in the Report of the 17th National Congress of the Communist Party of China, Putting the Construction of Anti-corruption and Building a Clean Government a Prominent Position in the Party’s Various Tasks and Carrying Through Prevention and Fighting Corruption to Achieve the Final Stage This has a bearing on the Party and state Life and death. However, with the rapid economic development in our country, the tremendous drive and temptation of interests have kept the internal corruption of the party alive. Many of them appear in the form of joint crimes. Such crimes of common corruption have greatly jeopardized the internal integrity of the Party and social public property. This article intends to correctly identify the common crimes of corruption by public officials from the aspects of definition, subjective, objective and common crimes of corruption, so as to better help the party to investigate and deal with violations of law and discipline and clean the ranks of the party.
