政策与法律之间存在着良性互动的关系,这可以我国计划生育事业的历史进程为证。两者的良性互动,有法政策学和行政过程论做理论基础,但是,两者的互动也存有功能上的障碍,为了更好的实现两者的互动,公众参与原则和法治思维原则,是必须坚持贯彻实施的。
