一物数卖中各买卖合同的效力以及标的物所有权的归属取决于物权变动模式的立法选择。大陆法系的物权变动的立法模式有三种:意思主义模式、物权形式主义模式和债权形式主义模式。我国《物权法》明确以债权形式主义为物权变动模式,规定了物权变动原因与结果区分原则,符合合同效力理论,也是诚实信用原则的要求。文章在此立法模式选择背景下,对物权变动模式的法理基础展开辨析,有利于探究一物数卖法律问题,以使法律规则更加明晰。
The validity of each contract of sale and purchase and the ownership of the subject matter depends on the legislative choice of the mode of change of real right. There are three legislative modes for the change of real rights in the civil law system: the mode of meaning, the mode of real right and the formal mode of claim. China’s “Property Law” explicitly claims the formalism as the real right of change model, provides for the principle of change in the real estate and the results of the principle of separation, in line with the theory of contract effectiveness, but also the principle of good faith requirements. Under the background of this legislative mode selection, the article analyzes the jurisprudence basis of the mode of real right change, which is helpful to explore the legal issue of one thing sale, in order to make the legal rules clearer.
