早在1789年《人权宣言》中,法国就向全世界宣布人的自由和平等的权利,其中包括公民自由结社的政治权利。但是法国真正实施和贯彻这条原则是从1901年6月投票通过/7月1日正式实施的非营利社团法开始。自该法通过并实施后几经修改,现在不仅仅是保障公民自由结社的法律依据,而且被纳入宪法之中。不过该法的出台不是一帆风顺的,自皮埃尔·瓦尔德克-卢梭于1883年首次提出该法的设想一直到1901年的实施,始终波折不断。本文拟通过对1901非营利性社团法的制定背景、内容和规制等的研究探讨法律对公民结社自由权的保障。
As early as the 1789 Declaration of Human Rights, France declared to the whole world the human right to freedom and equality, including the political rights of citizens to freedom of association. However, the French’s actual implementation and implementation of this principle began with the non-profit corporation law passed in June 1901 / formally implemented on July 1. Since the passage of the law and its subsequent revision, it is now not only the legal basis for guaranteeing the freedom of association of citizens, but also being incorporated into the Constitution. However, the introduction of the law was not plain sailing. Since Pierre Rudolf Rousseau first proposed the idea of the law in 1883 to 1901, it has been steadily changing. This article intends to explore the background, content and regulation of the 1901 non-profit association law to study the protection of law on civil liberties.
