科技飞速进步,经济高度发展,人类利用自然和改造自然的能力在不断加强,开始不加节制地开发和利用自然资源,导致环境问题越来越严重。在知识经济时代,科学技术是第一生产力,加上经济及科技全球化的大背景下,公民环境权入宪日渐成为决定企业、产业、区域乃至国家核心竞争力的关键因素。目前,环境权在我国的宪法中还没有得到明确确认,但是,对环境权宪法保障的探讨和研究对法学理论的发展具有十分重要的意义。
The rapid development of science and technology, the highly developed economy, the continuous enhancement of mankind ’s ability to use and transform nature and the uncontrolled exploitation and utilization of natural resources have led to an increasingly serious environmental problem. In the era of knowledge-based economy, science and technology are primary productive forces. Coupled with the globalization of economy and science and technology, the incorporation of citizens’ environmental rights into the Constitution has become a key factor that determines the core competitiveness of enterprises, industries, regions and even countries. At present, the environmental rights have not been clearly confirmed in our country’s constitution. However, the exploration and research on the constitutional protection of environmental rights are of great significance to the development of jurisprudence.
