代位继承制法定继承中的重要部分。随着家庭结构的变化,代位继承制显示出越来越多不合时宜的弊端。本文首先介绍代位继承制度出现的背景和原因,其次研究代位继承权的性质,将我国目前采用的代表权说与固有权说进行对比,分析代表权说的理论瑕疵;探究被代位人与代位人的范围、特殊情况下代位人应继份额分配方法等具体问题,最后针对以上问题给出相关立法方面的建议。
