慈善组织商业行为是社会舆论关注的焦点。学界和现行法律仅关注了慈善组织自身开展的商业活动,并未涉及合作开展的商业行为以及间接商业行为。间接商业行为包括积极投资行为和消极投资行为。积极投资行为有可能危害市场正常秩序,因此应当对慈善组织和附属机构的这类行为制定相关管理规定予以规制。消极投资行为属于正常投资行为,法律应予以积极保护。
Commercial behavior of charitable organizations is the focus of public opinion. The academic community and the current law only focus on the commercial activities carried out by the charities themselves and do not deal with the commercial activities and the indirect commercial activities carried out in cooperation. Indirect business practices include positive investment and negative investment. Positive investment behavior may endanger the normal order of the market. Therefore, relevant regulations on such behaviors of charitable organizations and affiliates should be formulated. Negative investment behavior is normal investment behavior, the law should be actively protected.
