本文针对学术界尚未对宪政理论研究的最基本问题——宪政的概念做出有公信力的解释这一现状,试图从历史与逻辑的角度来全面探讨关于宪政概念的科学界定。文章分为四个部分:宪政概念的语词解释与历史变迁;西方学者的宪政概念;中国学者的宪政概念;宪政概念的科学解析。本文认为,宪政是个非常复杂的概念,从本质与特征上讲,具有以下特性:相对确立性、层次性、环境依赖性、历史发展性、开放性。无论怎样理解,都必须弄清宪政概念的由来、本义,并区分何为内在本质,何为外在特征,这样方能全面完整地把握宪政的概念。
Aiming at the fact that the academic circles have not made credible explanations on the most basic issue of constitutional theory research yet, the concept of constitutional government attempts to comprehensively explore the scientific definition of constitutionalism from the angle of history and logic. The article is divided into four parts: the concept of constitutional interpretation of the word and historical changes; the concept of constitutionalism of Western scholars; the concept of constitutionalism of Chinese scholars; the scientific analysis of the concept of constitutionalism. This paper argues that constitutional government is a very complex concept, which has the following characteristics in terms of its essence and characteristics: relative certainty, hierarchy, environmental dependence, historical development and openness. No matter how we understand it, we must understand the origin and the original meaning of the concept of constitutional government and distinguish what is intrinsic and what is an external feature so that the concept of constitutional government can be fully and completely grasped.
