在热点案件的审理过程中,法官必须直面民意与法意的冲突,其境况十分窘迫。汉娜·阿伦特认为,人具有生命、世界性、复数性三种境况。相应的,人在这三种境况中会有三种不同的活动,即劳动、工作与行动。同样,热点案件中的法官也面临着三种境况,即生存问题、现行法秩序以及不断出现的新情况。在不同的境况下,法官的裁判行为有着不一样的性质。在依法裁判这一审判元规则之下,法官的裁判行为应当以“劳动”为基础,以“工作”为原则,以“行动”为例外,这应当成为审理热点案件的新常态。
In the hearing of hot cases, the judge must confront the conflict between public opinion and the law, and the situation is very embarrassed. Hannah Arendt argues that people have three situations of life, cosmopolitan and plural. Correspondingly, there are three different kinds of human activities in all three situations: labor, work and action. Similarly, judges in hot spots face three situations, namely, the issue of survival, the current legal order and emerging new situations. In different situations, the judge’s referee behavior has a different nature. Under the rule of judicial trial, the judges’ judgments should be based on “labor ” and the principle of “work ”, with the exception of “action ”, which should be considered as a hot case New normal.
