热心朋友将聚会后的醉酒者送到宾馆休息,进行登记时使用的是送人者的身份信息,醉酒者并没有进行登记。随后送人者陪同或独留醉酒者在房中休息。醉酒者神智不清时开窗通风发生坠伤坠亡的事情屡有发生。本文通过分析醉酒者与酒店经营者之间的合同关系,探求醉酒者是否可以基于违约责任而要求损害赔偿,以求解决此类问题之道。
