宅基地使用权是法律赋予农民对土地享有的权利的重要内容。近年来,基层政府侵犯农民宅基地权利的现象屡屡发生。之所以出现这种状况,是政府对宅基地发展权的垄断、政府土地行政权行使的失范、土地征收程序的无序,和村委会在维护农民宅基地权利的无力、基层民主不畅和农民话语权的缺失等因素共同作用的结果。
