中国是世界上单一制历史最长的国家,中央与地方的矛盾始终存在,导致了中国政治生活中集权与分权的不断循环。如何既能让中央对地方行使有效的控制权,又能使地方在享有一定的自主权的条件下充分发挥它们的积极性,是中央与地方关系问题的永恒主题。本文通过选取的中国西部地区三个具有代表性的经验实证材料,分析了中国地方经济法治在转型宪政背景下存在的问题及动态调整的可能,认为地方民主制度及制度能力的缺失是理解和解决问题的关键。最后,提出了建立地方利益的表达和协调机制以及通过发扬地方民主加强地方与地方协调合作的解决思路,以期探寻区域经济发展的法治基础。
As China has the longest history of unitary system in the world, the contradictions between the central and local governments have always existed, leading to a continuous cycle of centralization and decentralization in Chinese political life. How to enable the central authorities to exercise effective control over the localities and enable localities to give full play to their enthusiasm under the conditions of enjoying certain autonomy are the eternal themes of the issue of the relations between the central government and local governments. Based on the selected three empirical empirical materials in the western region of China, this paper analyzes the existing problems and the possibility of dynamic adjustment in the context of the transitional constitutionalism in China’s local economic law. It considers that the lack of local democratic system and institutional capacity is to understand and solve The crux of the problem. At last, it puts forward the solution of establishing the expression and coordination mechanism of local interests and strengthening the coordination and cooperation between the localities and local governments through the promotion of local democracy in order to explore the basis of the rule of law for the development of regional economy.
