针对我国法学教育评估面临的诸多问题,业界多缺乏清晰定位与实践驱动,传统上单纯基于入学情况、科研成果发表以及就业比率高低进行的教育评估实效性严重不足。从国际通例来看,主客观指标视角下的法学教育评估是较为有效的理论模型和研究工具。一方面,通过学术声誉、雇主声誉、社会声望等主观指标可审视法学教育的声誉评价,进而可用来分析其对教育声誉提升的影响;另一方面,导入以引用率、生师比为主要内容的客观指标体系,使之与主观指标相结合,实现量与质的统一,有助于提高法学教育评估的科学性与推动作用。在当前的中国法学教育评估中,要特别注意考虑法学教育的特殊性,立足中国国情,由综合评估向立体评估延伸,在民主指标方面扩大公众参与,并与“双一流”建设有效融合。
In view of the many problems facing legal education assessment in our country, there is a lack of clear positioning and practice driven by the industry. Traditionally, the educational evaluation based on the admission situation, the publication of scientific research results, and the employment ratio has a serious shortage of effectiveness. From an international perspective, the assessment of legal education under the perspective of subjective and objective indicators is a more effective theoretical model and research tool. On the one hand, subjective indicators such as academic reputation, employers’ reputation, and social prestige can be used to examine the reputation evaluation of law education, which can then be used to analyze its impact on the promotion of education reputation. On the other hand, the introduction of the reference rate, student-teacher ratio as the main content Objective index system, so that it can be combined with subjective indicators to achieve the unification of quantity and quality, which helps to improve the scientific and promoting evaluation of legal education. In the current assessment of legal education in China, special attention should be paid to considering the particularity of legal education, based on China’s national conditions, extending from comprehensive evaluation to three-dimensional assessment, expanding public participation in democratic indicators and effectively integrating with “dual-stream” construction .
