农村土地承包经营权入股流转是当前我国学界和决策界共同关注的一个话题。通过我国土地承包经营权入股流转现有三种实践模式优、缺点的分析研究,得出当下可行的土地承包经营权流转模式为入股农民专业合作社。指出了入股农民专业合作社存在的现实障碍和法律困境,并提出了对策及建议。
Circulation of stock ownership of rural land contracting and management right is a topic of common concern in academia and decision-making circles in our country at present. Through the analysis of the advantages and disadvantages of the three existing practice modes of the land contractual management right transfer in China, it is concluded that the current transferable mode of the land contractual management right is the peasant professional cooperative. It points out the practical obstacles and legal difficulties existing in the farmer cooperatives, and puts forward countermeasures and suggestions.
