传统观点认为辛亥革命处于动荡不居的特殊时期,司法成就甚微。其实不然,辛亥革命不仅是一场伟大的政治革命,也是一次广泛的法学革命。以孙中山为代表的资产阶级革命党人以近世西方民主、自由和人权理念为原则,在扬弃晚清司法制度的基础上进行了深入的司法变革,取得了较大的成就。
The traditional view that the Revolution of 1911 in turmoil in a special period, the judicial achievements are minimal. In actual fact, the Revolution of 1911 is not only a great political revolution, but also an extensive legal revolution. The bourgeois revolutionaries, represented by Sun Yat-sen, conducted in-depth judicial reforms based on the principles of modern Western democracy, freedom and human rights and achieved remarkable achievements in abandoning the judicial system of the late Qing Dynasty.
