《物权法》、《房屋登记办法》实施后,预告登记类业务大量增多,加之房产抵押登记数量迅猛增加,出现了注销登记后纸质档案的管理问题。2012年6月1日正式施行的《房地产登记技术规程》对房产抵押登记、预告登记、地役权登记、查封登记、异议登记注销后纸质档案销毁范围、保存时间进行了界定。本文重点以预告登记、房产抵押登记等注销后房产档案处置问题为切入点,全面阐述房产档案保管利用的法律依据。同时,分析我国房产档案管理利用现状,进而对房产档案管理队伍建设提出了合理化建议。
After the implementation of “Property Law” and “Registration of Housing Measures”, it is forecasted that there will be a large increase in the number of registered businesses. In addition, the number of real estate mortgage registrations will rapidly increase, resulting in the management of paper archives after the cancellation of registration. June 1, 2012 formally implemented the “real estate registration technical regulations” on the real estate mortgage registration, notice of registration, easements registration, seizure registration, objection to the registration of the cancellation of the paper archives after the destruction of the scope of storage time. This article focuses on pre-registration, real estate mortgage registration and other real estate file disposal after the cancellation as a starting point, a comprehensive exposition of the legal basis for the safekeeping of real estate files. At the same time, the status quo of the management and utilization of real estate archives in our country is analyzed, and reasonable suggestions are put forward for the construction of real estate archives management team.
