案情回顾:2011年,江门市华升饼业有限公司(以下简称华升公司)发现乌鲁木齐市沙依巴克区好人家食品经营部业主戚颖在经营期间,销售忆丰(福安)食品有限公司(以下简称忆丰公司)生产的“诚忆”牌奶油饼干与自己生产的曲奇饼干商标图案十分相似。华升公司通过公证保全的方式购买了忆丰公司生产的饼干,经对比,忆丰公司包装袋上的“大奶牛”图案与华升公司的注册商标图案构成近似。
Case Review: In 2011, Jiangmen Huasheng Bakery Co., Ltd. Huasheng Company purchased the crackers produced by Yi Feng Company by way of notarial preservation. By contrast, the pattern of “Big Dairy” on Yifeng’s packaging bag is similar to the registered trademark of Huasheng Company.
