确立沉默权制度 ,是我国应当履行的国际义务 ,也是无罪推定原则和对抗式诉讼结构的要求 ,它有利于诉讼效率的提高。我国确立沉默权制度的条件已经成熟 :市场经济的存在和发展为沉默权制度提供了社会经济基础 ;人们道德观念的变化 ,使沉默权制度有了植根的土壤 ;实行沉默权制度的物质技术条件已基本具备 ;形成了沉默权制度生存的法治空间。
The establishment of the system of right to silence is an international obligation that our country should fulfill, and is also the requirement of presumption of innocence and the structure of adversarial litigation. It is conducive to the improvement of litigation efficiency. The conditions for the establishment of the right to silence in our country are ripe: the existence and development of a market economy provide the socio-economic basis for the system of the right to silence; the changes in people’s moral values have rooted in the system of the right to silence; the material technologies that implement the system of the right to silence The conditions have been basically met; a space of rule of law for the survival of the right to silence has been formed.
