2000年7月美国的“Toysmart.com案”由于是首家进入破产程序同时又涉及消费者隐私权保护的案例而受到了公众的广泛关注,2002年上半年我国的北京首都在线科技发展有限公司(简称263)单方面中止对用户提供的免费电子邮箱服务也在用户与业界引起了轩然大波。本文详细地分析了在这一事件中,263的行为不仅是合同违约行为,而且竞合了对用户隐私权的侵权行为,希望263事件能为有关立法部门敲响警钟———立法保护公民隐私权已是网络经济的发展无法回避的问题。
In July 2000, the “Toysmart.com case” in the United States was widely publicized due to being the first case that went into bankruptcy proceedings and involved in protecting the privacy rights of consumers. In the first half of 2002, Beijing Capital Online Technology Development Co., Ltd. (Referred to as 263) to unilaterally terminate the free e-mail service provided to users also caused an uproar in the user and industry. This article analyzes in detail the behavior of 263 in this incident not only as a contractual breach of contract but also competing for infringement of user privacy rights and hopes that the 263 incident will sound the alarm for the relevant legislature --- legislation to protect the privacy of citizens Right has been the unavoidable issue of the development of the network economy.
