加强对难民的保护既是人道主义的要求,也是维护国际和平的安全使然。当前,国际上对难民保护的法律权益还不完善,导致不接受难民的趋势越来越严重,难民保护工作存在较多的问题。针对这一问题应该采取一系列的法律措施,第一,需要对难民定义进行修改,强化各国难民保护意识,给予不符合既有难民定义却仍处于与难民同样境地的人援助。第二,强调国际人权法在难民保护中的主要作用,将人权充分运用到难民保护领域当中,为难民国际保护奠定良好的基础。
To strengthen the protection of refugees is both a humanitarian requirement and a security guarantee for the maintenance of international peace. At present, the legal rights and interests for the protection of refugees in the world are still not perfect. As a result, the trend of not accepting refugees is getting more and more serious, and there are still many problems in the protection of refugees. A series of legal measures should be taken to address this issue. First, there is a need to amend the definition of refugees, strengthen the awareness of refugees in all countries and provide aid to those who are not in the same definition as the existing refugees but are still in the same situation as the refugees. Second, stressing the major role of international human rights law in the protection of refugees and fully applying human rights in the field of refugee protection, lay a sound foundation for the international protection of refugees.
