市场准入程序作为公用事业特许经营的首要环节,是重要的监管手段,其重要性是由公用事业的自然垄断性质决定的,也是克服目前部分失败案例中的困境所需要明确的。目前准入方式多种多样,各有特点,招标人应当根据项目的易标准化程度和竞争激烈程度选择合适的准入方式。公开招标程序作为最具竞争性的准入方式,应当作为公用事业特许经营的首选方式。公开招标的目的在于充分利用公平竞争机制择优确定经营者。但在实践中,往往因为信息不充分、串通投标等致使竞争不足而损害了公开招标的效果。因此,公开招标的有效实施需要政府确保招标阶段的有效竞争。科学的程序设计可以实现准入过程中的有效、公正竞争。借鉴台湾相关法律文本中的规定,本文提出了完善公开招标程序的几个关键问题,包括聘请专业机构、注重可行性研究、保证有效竞争、分阶段评审程序、设定合理评审标准、评审委员会的设立。 As the most important part of the concession of public utilities, the market access procedure is an important regulatory measure whose importance is determined by the nature of the utility’s monopoly. It is also needed to overcome the difficulties in the current failure cases. At present, there are many kinds of admittance ways and different characteristics, and the tenderee should choose the appropriate way of entry according to the degree of easy standardization and intense competition of the project. As the most competitive mode of entry, the open bidding process should be the preferred method of public service franchising. The purpose of open bidding is to make full use of fair competition mechanism to determine the operator. However, in practice, the effect of public bidding is often undermined by inadequate information and collusive bidding. Therefore, the effective implementation of open bidding requires the government to ensure effective competition during the bidding stage. Scientific programming allows for effective and fair competition in the access process. Drawing on the provisions in the relevant legal texts in Taiwan, this paper proposes several key issues for improving the open bidding process, including hiring professional bodies, focusing on feasibility studies, ensuring effective competition, reviewing the procedures in stages, setting reasonable standards of review, set up.
