古典自由心证制度,自1808年为法国刑事诉讼法典明确滥觞至今,作为一个时代的产物,有其相对于旧时证据认定制度,即法定证据制度而言优越之处,亦在发展的过程中存在许多纰漏与缺陷.该制度中心证不受制约及秘密心证的特征在很大程度上与现今社会中所强调的诉讼经济、实质正义与程序正义并重以及当事人诉讼权利保护等理念相背离.故,承认此种制度合理之处,在充分发挥法官主观能动性的基础上进行相应的制度限制,以及心证公开的强化,便成为了古典自由心证制度走向现代自由心证制度过程中所亟需落实之对象.
