为了使公安机关能够更好地履行维护社会稳定、惩治犯罪分子的职责,《中华人民共和国枪支管理法》规定人民警察依法享有配枪的权利,并指出当出现紧急情况时人民警察可以使用配枪。但是在现实的公安工作中,我们看到更多的却是民警用枪时的迷茫与困境:主要表现为很多民警不愿意佩戴枪支或者是在发生紧急情况时不会或不敢开枪。这其中有制度的缺失,有法律法规的影响,有民警自身的因素甚至包括整个社会大环境的作用。本文试图从其一点,即从法律规范的角度对当前公安机关警务用枪的现状展开探讨,为今后的立法工作提供有益借鉴。
In order to enable the public security organs to better perform their duties of safeguarding social stability and punishing criminals, the People’s Republic of China Gun Management Law stipulates that the People’s Police shall enjoy the right to allocate guns in accordance with the law and point out that the People’s Police may use guns when an emergency occurs . However, in actual public security work, we have seen more confusion and dilemmas when using police guns. The main manifestation is that many police officers are unwilling to wear firearms or can not or can not fire guns in the event of an emergency. Among them are the lack of systems, the impact of laws and regulations, and the factors of the police themselves even include the role of the entire social environment. This article tries to discuss the status quo of police guns currently used by public security agencies from the perspective of legal norms and provide useful reference for future legislative work.
