基因治疗技术水平不断进步的同时,人们对其的认知也愈趋理性和客观。结合基因治疗发展的状况,对基因治疗应用于临床医学可能引起的相关法律问题展开讨论,并对我国基因治疗应用于临床医学方面的立法进行探讨,提出包括治疗方案的审核、治疗过程的监督管理、相关的侵权问题以及治疗方法本身的专利保护等立法建议。
While the level of gene therapy technology continues to improve, people’s perception of them becomes more rational and objective. Combining with the development of gene therapy, this paper discusses the potential legal problems caused by gene therapy in clinical medicine and discusses the application of gene therapy in clinical medicine in China.
