1、机关、事业单位工作人员,在不违反国家法律法规和政策规定的前提下,经本人申请、所在部门或单位同意,可离职从事个体经营、兴办私营企业或到其他部门民营企业工作。离职期间,三年内人事关系可暂留在原单位代管,工龄连续计算(实行机关事业单位养老社会保险统筹的应按规定缴纳养老保险费)。三年内原工作部门或单位面向社会公开招聘录用工作人员时,经本人申请、单位同意,可以免视回原单位工作。
