十八届三中全会提出,全面深化改革的总目标就是完善和发展中国特色社会主义,推进国家治理体系和治理能力现代化。习近平总书记指出:“推进国家治理体系和治理能力现代化,当然要高度重视法理问题,采取有力措施全面推进依法治国,建设社会主义法治国家,建设法治中国。”审判工作是国家治理体系中的重要组成部分,推进国家法治能力现代化的提出,为审判能力现代化指明了方向和路径。笔者认为,审判能力现代化应从以下几个方面加以认识。
