Recently, the Ministry of Human Resources and Social Security announced the revised Arbitration Rules for Labor and Personnel Disputes (hereinafter referred to as the New Rules for Handling Cases) and the Arbitration Organization Rules for Labor and Personnel Disputes, which will go into effect on July 1, 2017. The “Labor Dispute Mediation and Arbitration Law” which came into force on May 1, 2008 established the final arbitration system for labor disputes. However, as to how to implement the final ruling, the implementation of laws and regulations in various places has not been unified and has not fully met the expected effect of legislators. On the basis of summing up local experience, the new “handling rules” focus on enhancing the operability of the final ruling.
