当前对小产权房升值和离婚财产分割的司法实践模式表明:法院在审理案件时并不一定会按照最有经济效率、最能符合法律制度预设的方式进行。小产权房交易被认定无效后,将升值的大头判给原卖方,无助于为此等买卖提供有效负面激励,而可能只是为了判决的执行便利性。离婚财产基本均等分割可能主要是由于法官希望降低说理负担,回避考察夫妻间过错因素对财产分割比例的影响值。这反映了法官趋利避害、降低审判成本的法经济学考量和对特定群体倾斜性关照与否以便息事宁人的法社会学考量。
At present, the judicatory mode of practice on the appreciation of small property houses and the division of divorce property shows that the court may not always follow the most economical and most preconditioned legal system when handling cases. When a property transaction is found to be invalid, the decision to award the bulk of the appreciation to the original seller does not help to provide effective negative incentives for the sale of the property, but rather may be merely for the convenience of execution of the judgment. The basic equal division of divorce property may be mainly due to the judge hoping to reduce the burden of reasoning and avoid examining the impact of the fault of husband and wife on the proportion of property division. This reflects the legal and socio-economic considerations of judges seeking benefits and avoiding disadvantages, reducing the cost of adjudication of judiciary and the inclination of specific groups to take good care of others.
