2014年民事案件案由规定将土地承包经营合同纠纷分为6类:(1)土地承包经营权转包合同纠纷;(2)土地承包经营权转让合同纠纷;(3)土地承包经营权互换合同纠纷;(4)土地承包经营权入股合同纠纷(5)土地承包经营权抵押合同纠纷(6)土地承包经营权出租合同纠纷,它将本质上是合同纠纷的土地承包经营权确认纠纷列为了物权纠纷。关于土地承包经营合同纠纷的解决大多数学者只是在制度外探讨土地承包经营合同纠纷的仲裁、调解、和解、诉讼纠纷解决机制的运用,对于从制度内深入讨论土地承包合同纠纷解决的路径,学界对此的探讨是不充分的。笔者将将从土地承包经营权与土地承包经营合同的关系角度入手,讨论土地承包经营合同的性质,进而深入探讨我国未来对于土地承包合同纠纷的解决方法。
