随着社会的发展和变革,刑事诉讼法也必然发展和变革。美国没有统一的刑事诉讼法典,美国律师、法官和其他涉及刑事诉讼司法制度的人员都常常直接依据宪法而不是其他法典。这导致每年的刑事诉讼规则都有很多新的发展。其中最重要的涉及米兰达规则、在陪审团审理的刑事案件中,被告人有获知重要事实的权利和排除合理怀疑的证明标准等规则。
With the development and reform of society, the Criminal Procedure Law will inevitably develop and change. The United States does not have a uniform Code of Criminal Procedure, and U.S. lawyers, judges and other personnel involved in the criminal justice system are often directly based on the Constitution and not on other codes. This leads to many new developments in the annual rules of criminal procedure. The most important of these concerns the Miranda rules. In criminal cases before the jury, the defendant has the right to know important facts and the rules that justify excluding reasonable suspicions.
